These Terms of Service ("Terms") govern your use of Tapnudge ("Tapnudge", "we", "us", "our"). By accessing or using Tapnudge, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be able to form a legally binding contract to use Tapnudge. If you are under the minimum age required in your jurisdiction, you may not use the service.

2. Your Account

  • You are responsible for your account and any activity under it.
  • You must provide accurate information and keep your credentials secure.
  • We may suspend or terminate accounts for violations or risk to the platform.

3. User Content

"User Content" includes nudges, polls, images, text, tags, votes, profile content, and any material you submit.

Ownership

You retain ownership of your User Content.

License you grant to Tapnudge

To operate and promote the service, you grant Tapnudge a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify for formatting or technical purposes, distribute, display, and perform your User Content in connection with Tapnudge and its features, including sharing, ranking, recommendations, and safety moderation.

This license ends when your content is deleted from the service, except where it has been shared with others, incorporated into aggregated statistics, or must be retained for legal or safety reasons.

Your responsibilities

You represent and warrant that you own or have the necessary rights to submit your User Content, and that it does not violate law or these Terms.

4. AI-Generated or AI-Assisted Content

If you use AI tools, inside or outside Tapnudge, to create content:

  • You remain fully responsible for that content, including legality, accuracy, and rights clearance.
  • AI-generated content may resemble existing works. You must ensure you have rights to share it and that it does not infringe others' copyrights, trademarks, or publicity rights.
  • We do not guarantee that AI outputs are original, non-infringing, or accurate.

5. Community Rules

You agree not to post, upload, share, request, or promote any of the following:

Illegal sexual content and exploitation

  • Any content that sexualizes or exploits minors, including child sexual abuse material, or any content involving a minor in a sexual context. This results in immediate account termination and may be reported to law enforcement.
  • Non-consensual sexual content, including revenge porn, sexual extortion, or any sexual content shared without permission.
  • Sexual content depicting exploitation, coercion, violence, or abuse.

Pornography and explicit sexual content

Pornographic or explicitly sexual content is not allowed. We may allow limited, non-explicit, non-pornographic adult nudity in strictly non-sexual contexts, but this is rare and may be removed at our discretion.

Violence, cruelty, and abuse

  • Content depicting or promoting animal cruelty, torture, or abuse.
  • Content depicting gratuitous gore or extreme violence.
  • Content encouraging violence, self-harm, or suicide.

Hate, harassment, and dangerous behavior

  • Hate speech or content targeting protected groups.
  • Harassment, threats, stalking, or doxxing.
  • Instructions or encouragement for wrongdoing, weapons misuse, or other harmful acts.

IP and privacy violations

  • Content that infringes copyrights, trademarks, or other rights.
  • Private or confidential information, your own or others', without permission.

Spam and manipulation

  • Spam, scams, fraud, impersonation, or attempts to manipulate votes or engagement.
  • Attempting to hack, disrupt, scrape, reverse engineer, or overload the service.

6. Moderation, Enforcement, and Removals

  • We may remove or restrict content, reduce visibility, add warnings, or suspend or terminate accounts at our discretion.
  • We may use automated systems, including AI, and human review for moderation.
  • We are not obligated to monitor all content, and we do not guarantee removal of all prohibited content.

7. Copyright and IP Complaints

If you believe content infringes your rights, contact support@tapnudge.com with:

  • Identification of the work claimed infringed.
  • The infringing content or link.
  • Your contact information.
  • A statement of good-faith belief and authority.

We may remove content and take action against repeat infringers.

8. Third-Party Services and Links

Tapnudge may integrate or link to third-party services. We are not responsible for third-party content, policies, or practices.

9. Service Availability, Changes, and "As Is"

Tapnudge is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We may change, suspend, or discontinue any part of Tapnudge at any time.

10. Limitation of Liability

To the maximum extent permitted by law, Tapnudge will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to the service will not exceed the amount you paid us, if any, in the 12 months before the event giving rise to the claim, or USD $50 if you paid nothing.

11. Indemnification

You agree to indemnify and hold harmless Tapnudge from claims arising out of your use, your User Content, including AI-generated content, or your violation of these Terms.

12. Termination

You may stop using Tapnudge at any time. We may suspend or terminate access at any time for violations, risk, or legal compliance.

13. Changes to These Terms

We may update these Terms. Continued use after changes means you accept the updated Terms.
